Stencilbum Terms and Conditions

1. Definitions
“Stencilbum” means Ashley Filmer, Trading as Stencilbum, Registered address:- 41 Alstone Croft, Cheltenham, Glos, GL51 8HB. “The Client” means any person, body of persons, firm or Company with whom Stencilbum enters into a contract with for the sale of goods or provision of services by the Stencilbum.

2. Acceptance of Terms and Conditions
All contracts and transactions between Stencilbum and the Client whether made orally or in writing are subject to these terms and conditions which shall be deemed to be incorporated into any contract between Stencilbum and all or any of its Clients.

3. Copyright and Ownership
In accordance with the Copyright, Designs & Patents Act 1988, the copyright of all stencils, images and literature created by Stencilbum is owned by the Stencilbum. The Stencilbum clipping system (patent pending) is the intellectual property of Stencilbum.  

Reproduction rights granted with the provision of Stencilbum in electronic format such as, but not limited to, digital Compact Disc or equivalent digital media are strictly limited to personal use of the client and not for resale or distribution for commercial benefit unless specifically agreed in writing with Stencilbum.

All original images, transparencies and digital files created by Stencilbum remain the property of Stencilbum. Stencilbum reserves the right to make reproductions of images created during assignments or commissions for marketing, promotional, competition and editorial purposes.

4. Cancellation Fees / Overruns
If a booking is cancelled by the Client within one working day of the starting time, Stencilbum reserves the right to charge the full fee for the assignment. If a booking is cancelled within two working days of the starting time, Stencilbum may charge 50% of the fee.

Stencilbum may make additional charges should an assignment overrun which is beyond the control of Stencilbum (e.g. including but not limited to; the Client requesting additional design work over and above the Client’s original brief etc).

5. Payment Terms
Payment for all products and services provided by Stencilbum must be made prior to despatch or commencement of the contracted services.

6. Retention of Title
Stencilbum reserves the right to retain all of the Clients materials in his possession until all monies owed to Stencilbum have been paid in full.

7. Liability
The Client agrees that in all dealings with Stencilbum, Stencilbum's liability will be limited to the consideration in respect of products and services provided.

8. Delivery of Products and Services
The supply of products and services are provided by Stencilbum on a best endeavours basis. Stencilbum shall not be liable for any delays in meeting any of its obligations which were due to causes beyond reasonable control including but not limited to; postage/courier/printing delays, loss or damage in transit etc.

9. Images/Data Supplied in Electronic Format
For all images/data supplied to the Client in electronic format (including but not limited to electronic mail, CD’s/DVD’s etc), Stencilbum will endeavour to ensure that the data sent is not corrupt and is virus-free. Stencilbum cannot be held responsible for any damage, disruption and/or loss of any kind that the said media may cause to the Clients computer or data.

10. Prices & Terms
All prices shown within the Stencilbum price list are subject to change without prior notice.
Stencilbum reserves the right to amend these Terms and Conditions without prior notice. Stencilbum shall not be held liable for any customs charges or import tax incurred whilst shipping outside the United Kingdom or its sovereign territories.

11. Law
This Agreement shall be subject to and constructed according to English Law and the parties agree to accept the exclusive direction of the Courts of England.
